At Babiem (“Babiem”, “we”, “us”, “our”) we value your privacy. This privacy statement applies to the use of our website ( www.babiem.com , the 'Site') and our services. We only collect data that is necessary for a pleasant shopping experience and to improve our services. Here you can read what data we collect, how we use it, secure it and, where necessary, share it with third parties. We also explain what rights you have. By 'you' and 'your' we mean every user of our website, whether you are a customer, visit the Site or otherwise interact with us.


Babiem processes personal data in accordance with the General Data Protection Regulation (GDPR). This means that we are transparent about what data we collect, why we do this and how we protect it. We ensure that your data is treated carefully and only used for legitimate purposes.

The information we collect depends on your interaction with our Site. Additionally, as you browse the Site, we collect information about the pages you view, the websites or search terms that referred you to us, and how you interact with the Site. Further data we collect on our Site, depending on the form of interaction:

  • Payment details: only necessary bank details and payment method(s), for legal obligations such as tax administration.

  • Marketing preferences: such as newsletter subscriptions

  • Participation in competitions and events: In order to carry out the promotion or organize an event, we may need personal data, such as name, email address, possibly telephone number and address depending on the promotion or event.

  • Technical data: IP address, web browser and cookies to improve the website and service. This data is not considered personal data because it does not identify a specific person.

  • Customer Support Information: including information you share with us, for example when you have a question.

3. Why we process personal data

We use your data exclusively for the purpose of our services. This means that we process your data to process your order, provide our customer service, optimize our webshop and manage participation in contests and events. Your data will only be shared with third parties when this is necessary for these purposes.


4. Legal bases for data processing

We only process personal data when there is a legal basis for this, as prescribed in the General Data Protection Regulation (GDPR). This means that we process personal data based on one or more of the following bases:

  1. Performance of a contract - when you place an order with Babiem, we process your data to perform the contract. This includes processing payments, shipping products and providing customer service (Article 6 paragraph b of the GDPR).

  2. Consent - for certain forms of data processing we ask your consent in advance. This applies, for example, to receiving our newsletter or showing personalized advertisements. You can adjust your preferences or withdraw consent at any time (Article 6 paragraph 1 sub a of the GDPR).

  3. Legal obligation – in some cases we are legally obliged to process and store certain personal data, for example for our accounting and tax administration (Article 6 paragraph 1 sub c GDPR).

  4. Legitimate interest - we may process personal data on the basis of a legitimate interest, provided that your privacy interests do not outweigh this. This may be the case, for example, when analysing website use to improve our services or when securing our systems. When we rely on this basis, we always carefully weigh up our interests against your privacy rights (Article 6 paragraph 1 sub f of the GDPR).

Your data will never be processed without reason and we ensure that the processing is always in line with applicable laws and regulations.

 

5. How long your data will be kept

We do not retain your data for longer than is necessary for the purpose for which it was collected. The retention period varies per type of data and is based on legal obligations, operational necessity and legitimate interests such as customer service and analytical purposes.

  • Order data will be retained for as long as legally required.

  • Customer service and contact details will be retained for as long as they are relevant to providing service.

  • Newsletter subscriptions will be kept until you unsubscribe.

  • Account data will be retained as long as the account is active. Upon deletion, the data will also be deleted, unless legal obligations require otherwise.

  • Website data and cookies are stored according to your browser settings and selected cookie preferences.

  • Competition and event data will be retained for a reasonable period after the end of the competition or event, after which it will be deleted unless legal obligations require otherwise.

  • Data based on legitimate interest (such as website analysis and fraud prevention) will not be stored longer than necessary and will be evaluated periodically. You have the right to object to this processing. Please note that certain data is required for optimal service provision. In some cases, limiting or deleting this data may affect the service for which the data is required.

In some cases we may delete the data earlier, for example if requested and there is no legal obligation to retain it.

 

6. Who we share personal data with (third parties)

  • Shopify (webstore and emails)
    Our webshop runs on Shopify, a platform that helps with orders, payments and customer communication. Shopify collects technical data (such as cookies) to make the website work properly, but does not use personal data for its own purposes. Emails, such as order confirmations and newsletters, are also sent via Shopify.
  • Gmail (customer service)
    For emails and customer questions we use Gmail. These emails are secured and remain private.
  • Payment providers
    For a safe and fast payment we work together with iDeal, creditcard, PayPal, Bancontact and Klarna: they process your payment details and protect them with strict security measures. In case of deferred payments Klarna can perform a credit check.

    Your data will only be used to process the payment and will not be stored for longer than legally permitted.
  • Shipping Partners
    In order to deliver your order quickly and carefully, we share your name, address details and email address with our delivery partners: DHL and PostNL and fulfilment centre Monta WMS. This information is only used to deliver your package to you.
  • Rating systems
    Want to leave a review? We work with Trustpilot to collect honest reviews. Your name and email address will only be used to connect your review to your order.
  • Marketing tools and partners
    In order to run relevant advertisements and marketing campaigns, we work with external marketing agencies and advertising platforms, such as Meta (Facebook & Instagram), Google Ads and other marketing tools. These partners can use data such as click behavior, cookie data and preferences to tailor advertisements, but do not have access to your personal data such as name or address.
  • IT services and cloud storage
    For the operation of our webshop we use various IT services and cloud storage solutions. This includes hosting services, backups and technical support.

    Shopify is our primary platform for the webshop, where various personal data is stored, including:
  • Order information (name, address, email address, telephone number and order history).

  • Account information (if applicable, such as username and password).

  • Invoice information (for administrative purposes.

Shopify ensures that this data is stored securely and meets strict security standards. Other IT service providers may be granted limited access to data if this is necessary for maintenance, support or security. All these parties treat personal data as strictly confidential and process it only in accordance with our instructions.

  • Accounting and administration
    For our invoicing and administration, we only process the necessary data for financial administration, such as the amounts settled and VAT statements. Although orders are processed administratively, personal data such as name and address are not important and are not actively stored or used.
  • External sales channels/platforms
    Within our Holding, sister organization Faas Commerce BV handles the processing of order data and the shipping of orders for us. They receive the order data from the platforms to process your order. They handle this information carefully and do not share anything without your permission.

7. User rights (GDPR rights)

If you live in Europe, you are entitled to:

  • Inspection: your personal data

    • Inspection: You have the right to know which personal data is collected and for what purpose.

    • Adjust: adjust your personal data.

    • Removal: You may have certain outdated or incorrect privacy-sensitive information removed.

  • Restricting data processing or objecting to its use, provided that this is not necessary to comply with legal obligations.

  • To request and transfer your data to another party.

  • Objection: to object to the processing of your personal data based on:

    • Legitimate interest: the company must stop processing unless there are compelling reasons.

    • Direct marketing: the company must immediately stop using the data for marketing purposes.

  • Babiem does not use automated decision-making or profiling that has legal or similar consequences for users.

Please note that your personal data will be transferred to countries outside of Europe, including Canada and the United States (including through the use of our website via Shopify).

Our store is powered by Shopify, which is GDPR compliant and uses the Standard Contractual Clauses (SCCs) for international data transfers. You can learn more about this in Shopify's privacy policy .

We may need to collect information about you to verify your identity, such as your email address, name, phone number or account information, before we can provide a substantive response to your request.

Although we make every effort to protect your data as best as possible, no security measure is completely impenetrable. We cannot guarantee absolute security, especially when transmitting data via the internet. We therefore recommend that you do not share sensitive or confidential information with us via unsecured channels.
